| Red Opia welcomes your business.
Its terms of trade are regulated by The Consumer Protection (Distance
Selling) Regulations 2000 (SI 2000 No. 2334). These regulations
transpose into UK law the European Directive 97/7/EC on the protection
of consumers in respect of distance contracts. Any order placed
with Red Opia, whether via the internet, on interactive digital
television, mail order, catalogue shopping, telephone, fax or as
a result of any advertisement on television, radio or in newspapers
or magazines is subject to the following terms and conditions.
Confirmation of Order:
You will receive an email to confirm receipt
of your order when payment has been authorised, or in the case of
Trade Account Customers, when a check has been done that the total
value of goods ordered, together with any outstanding payments does
not exceed your agreed credit limit. The email will confirm the
supplier’s name and address, goods ordered, price and delivery
costs, a statement as to whether payment has been made or is still
to be made, and confirm your right to a cooling off period during
which you may cancel the order for any reason.
Cooling Off Period:
You have the unconditional right to cancel the
order for any reason up to seven working days after the receipt
of your goods or any part of your order. Should you wish to exercise
this right, you should return the goods to Red Opia, unused in accordance
with the Returns/Refunds Policy set out below.
Delivery costs:
Delivery within the UK is recharged at cost and
calculated by weight and location using Royal Mail up to 30kg. Delivery
outside the UK is by airmail using Royal Mail for packages weighing
up to 2kg. Non-UK deliveries in excess of this weight are sent by
airmail and recharged at cost using the services of an international
carrier. UK deliveries to Trade Account Customers may be by courier
at the Customer’s request and cost.
Description of Goods:
All goods are as described by Red Opia in any
internet site, catalogue, advertisement published or issued by Red
Opia.
Despatch:
Goods will normally be despatched no later than
the end of the following working day. Upon despatch, you will receive
a further email to confirm that the order has been sent. If, for
any reason we have been unable to despatch your order within that
time, we will email you and let you know and tell you when we expect
to be able to make the despatch. If this is unsatisfactory to you,
you have the right to cancel your order and receive a full refund,
including, if cancelled before despatch, any delivery charges for
which you may have paid.
Disclaimer:
Whilst we endeavour to ensure information on
this website is accurate and complete, price, delivery, availability
and all other information may be subject to change without prior
notice.
Fraud:
If fraudulent use is made of your credit or debit
card, you are entitled to the protection given under the consumer
Credit Act 1974 (section 83) which entitles you to cancel the payment
and be reimbursed in full by the card-issuer.
Grievance:
If you have a grievance we will make every effort
to resolve it to your satisfaction. If we are unable to do so, you
have the right to complain to The Office of Fair Trading, Local
Authority Trading Standards Departments in England, Scotland and
Wales and the Department of Trade, Enterprise and Investment on
Northern Ireland.
Guarantees:
Due to the nature of the goods offered, Red Opia
does not offer any warranty or guarantees with its products. Where
thought appropriate, Product Care Advisory Notes are included with
goods that in our opinion require special care.
Hand Made:
Please note that many of the goods are handmade.
This may result in minor marks and blemishes consequent upon the
nature of the craft, or variations in colour, tone or shade, as
items are made individually. Products, may not therefore always
be exact replicas of the photographs used to display the product
type and if you are in any way dissatisfied with the items you have
purchased, please return them to Red Opia within 7 days as set out
in the Returns Policy.
Prices:
All prices are stated in UK pounds and include
VAT where applicable. Prices quoted to approved Trade Account Customers
do not include VAT, which will be added to the total and a VAT invoice
issued.
Privacy:
We collect information about you in order to
process your order and to provide you with an exemplary service.
The information you provide us will only be used in accordance with
the Data Protection Act 1998 and will not be divulged to third parties
other than as may be necessary to complete your order. In any such
cases, we will require the same level of privacy.
Refund/Returns Policy.:
If, for any reason, you are unsatisfied with the product, you may
return it to us within 7 working days of receipt. Please indicate
whether you would like a replacement or full refund. All refunds
or replacements are subject to the condition that the original item(s)
and internal packaging are unused. Please bear in mind that most
of our products are hand made and as such may contain minor marks
or blemishes, which reflect the nature of the craft. All goods are
checked before delivery to ensure fitness for purpose and that they
meet our exacting standards.
You will be responsible for the cost of returning
the goods to Red Opia, which will be refunded to you, at your request,
only in the event that the goods delivered to you were not what
you ordered or were defective or damaged, other than in transit.
All refunds will be made within 30 days of receipt
by Red Opia of the goods returned.
Substitute Goods:
If for any reason the item ordered is not available
and Red Opia offers a substitute product, which upon receipt and
inspection by you is not satisfactory to you, Red Opia will bear
the cost of you returning the substitute goods to Red Opia.
Security:
All transactions are handled by a secure server, which means that
neither Red Opia or any of its staff, ever have access to your credit
or debit card details. All payment processing is carried out by
an UK authorised Payment Service Provider. Credit card information
is encrypted, so you can shop in complete confidence. Should you
wish to pay by alternative method such as cheque or postal order
please allow 7 days for process prior to goods being despatched.

Terms of Payment:
Other than for approved Trade Account Customers, no contract will
subsist between you and Red Opia for the sale by it to you of any
product unless and until we have received funds for payment. Authorised
Trade Account Customers may spend up to their agreed credit limit
and shall pay all invoices outstanding within 30 days of the date
of the invoice.
Copyright:
Red Opia reserves the copyright to all Website design, text, graphics,
the selection and arrangement thereof and all software compilations,
underlying source code, software including applets and all other
material and contents on this website and online shop (Excluding
material in the public domain and with deference to acknowledged
trademarks or their content and technology providers), including
these Terms of Trading..
Copying of part or whole of this website or online
shopping facility is expressly forbidden unless electronically copying
the "Catalogue" for the sole purpose of study prior to
placing an order i.e. as a shopping resource. Any other reproduction,
in any form, of this website and online shopping facility for purposes
other than those noted above, modification, distribution or re-publication,
without the prior written consent of Red Opia is absolutely prohibited.
Your statutory rights are not affected.
Jurisdiction:
For the avoidance of doubt, all contracts will
be deemed to have been concluded in the United Kingdom and will
be subject to the laws of England and Wales and you and Red Opia
hereby agree to irrevocably submit to the non-exclusive jurisdiction
of the English courts.
